Digital Millennium Copyright Act Notice & Takedown Procedure

1. Copyright Infringement Notification

PRML Digital LLC ("Primal") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), 17 U.S.C. § 512, Primal will respond expeditiously to claims of copyright infringement committed using the Primal service.

2. Filing a DMCA Takedown Notice

If you believe that content on Primal infringes your copyright, please submit a written notification containing the following:

  1. A physical or electronic signature of a person authorized to act on behalf of the copyright owner;
  2. Identification of the copyrighted work claimed to have been infringed;
  3. Identification of the material that is claimed to be infringing, with enough detail so that we can locate it (e.g., URL or screenshot);
  4. Your contact information (address, telephone number, and email address);
  5. A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law;
  6. A statement, made under penalty of perjury, that the information in the notification is accurate and that you are authorized to act on behalf of the copyright owner.

3. Designated DMCA Agent

4. Counter-Notification

If you believe your content was removed in error, you may submit a counter-notification containing:

  1. Your physical or electronic signature;
  2. Identification of the material that was removed and its location before removal;
  3. A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification;
  4. Your name, address, telephone number, and a statement consenting to jurisdiction of the federal court in your district;
  5. A statement that you will accept service of process from the person who filed the original DMCA notice.

5. Repeat Infringer Policy

Primal maintains a policy of terminating the accounts of users who are repeat copyright infringers. If a user receives three valid DMCA takedown notices, their account will be permanently terminated without refund.

6. Non-Consensual Intimate Images (NCII)

In compliance with the TAKE IT DOWN Act, Primal will remove reported non-consensual intimate imagery within 48 hours of receiving a valid report. To report NCII, email legal@dateprimal.com with the subject line "NCII Removal Request."

7. Good Faith

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages, including costs and attorneys' fees.
